บทคัดย่อ |
Due to the project Thai Food to the World, Thai food industry has gained more heed from all over the world which results in a higher number of intellectual property thefts as well. The thefts are caused by insufficiencies of the existing intellectual property law of Thailand: Copyrights, Geographical Indications, Patents, Trademarks, and Trade Secrets. In order to find a solution, a thorough study of the international legal standards, legislations and practices from other jurisdictions regarding all intellectual property protections has been done for the purpose that a comparison with the existing intellectual property law of Thailand and an appropriate amendment can be done. The study reveals insufficiencies as follows: the copyrightability of recipes, the trade dress protection, and the geographical indications system. Copyrighted cookbooks in Thailand are still a dilemma whether the copyright was granted to the published books or the recipes while the copyrightability of recipes in other jurisdictions is subject to statutory provisions and additional regulations announced by the countrys copyright office. The protection of trade dress actually falls within the Trademark Act; however, since it is not defined in the Act, its protection is very narrow comparing to the protection in other jurisdictions which falls within the subject of both laws and court decisions. The other insufficiency is the protection under the Act of Protection of Geographical Indications of Thailand. Few food products are protected under this Act comparing to the ones in European Union due to a less systematic protection system. The protection in European Union is established by the Protected Geographical Status which likewise extends its protection to traditional specialty. The amendments relating to the mentioned insufficiencies should, therefore, be done as follows. The Department of Intellectual Property should provide a clear guideline on whether recipes can be copyrighted and how to get them done so. Trade dress should be added and defined in the Trademark Act to broaden the scope of protection and norms regarding functionality requirement should be established to provide a solid direction to restaurateurs and investors. The system of geographical indications protection should be improved either by extending the system to the protection for traditional knowledge for dishes like Gang Som or enacting a new law regarding traditional knowledge to provide an adequate protection to food industry. |
